General Terms and Conditions of BLUEMLE Motorsport & Events

This is a convenience translation. In case of any discrepancy, the German version of these terms is legally binding.

Scope

These general terms and conditions apply to all contracts for events, seminars, coaching, training, taxi and self-drive rides as well as other services offered by BLUEMLE Motorsport & Events (hereinafter the “organiser”). Deviating terms of the customer are not accepted unless the organiser expressly agrees to them in writing.

Offers and prices

Our prices are quoted in euros and include the applicable statutory VAT. The prices shown on the website or in the quote at the time of booking apply.

Conclusion of the contract

By submitting a booking or booking request (via form, e-mail or telephone), the customer makes a binding offer to conclude a contract. The contract is concluded upon our order or booking confirmation, which you receive by e-mail.

Payment

Payment is made by bank transfer. For payments from abroad, the customer bears all bank charges.

All types of events, seminars, coaching, taxi or self-drive rides offered by BLUEMLE Motorsport & Events must be paid for in advance.

Cancellation, rebooking, postponement

Booked and paid trainings and drives of any kind cannot be cancelled or refunded. There is no entitlement to drives of any kind on specific weekdays. A booked date can be rescheduled free of charge up to seven days before the start of the event. The cancellation fee for less than seven days before the respective event is 100 % of the purchase price.

BLUEMLE Motorsport & Events does not cover any travel costs whatsoever in the event of rebooking, cancellation or cancellation of a date.

Right of withdrawal

Consumers are generally entitled to a statutory right of withdrawal of 14 days for contracts concluded off business premises or by distance selling (e.g. via website, e-mail or telephone).

Note: Pursuant to Section 312g (2) no. 9 of the German Civil Code (BGB), there is no right of withdrawal for contracts for the provision of services in connection with leisure activities if the contract provides for a specific date or period for their provision. This applies in particular to bookings of events, trainings, taxi and self-drive rides on a fixed date.

Execution, changes and cancellation of events

The organiser reserves the right to postpone or cancel events for good cause (e.g. weather, official requirements, closure of the circuit, force majeure, insufficient number of participants). In this case an alternative date will be offered to the customer. Further claims, in particular for reimbursement of travel, accommodation or other costs, are excluded.

Participation requirements

Participation requires signing the liability waiver and participation declaration provided on site. The customer is obliged to meet the participation requirements applicable to the respective event (e.g. valid driving licence, suitable protective equipment, technical condition of the vehicle) and to follow the instructions of the organiser as well as of the track and safety personnel. In the event of violations, the customer may be excluded from the event without any claim to a refund.

Warranty and liability

Warranty is provided in accordance with statutory provisions. Any warranty is excluded for consequences caused by improper conduct of the customer or a third party or by failure to observe instructions and safety requirements.

Prohibition of assignment

The assignment of rights and/or the transfer of the customer's obligations under the contract is not permitted without the written consent of the organiser.

Place of jurisdiction

Unless statutory provisions state otherwise, Neuwied is the place of jurisdiction for merchants and customers without a general place of jurisdiction in Germany; for private individuals, their competent court is the place of jurisdiction.

Final provision

Any partial invalidity of these general terms and conditions resulting from changed legislation or supreme court rulings does not affect the validity of the concluded contract in its remaining points.

The contract can currently be concluded in German and English.
